TERMS AND LIABILITY INFORMATION
- The Client authorizes Car Freight Shipping INC. to hire a licensed and insured third-party carrier ("Carrier") to transport the aforementioned vehicle(s) as described in the quotation previously sent to the Client's email "Opportunities.Email" or provided via phone by the assigned sales representative.
- Car Freight Shipping INC. and the contracted Motor Freight Carriers are authorized to operate and transport the motor vehicle(s) between the agreed upon locations outlined in the B.O.L. (Bill of Lading).
- The Client acknowledges that Car Freight Shipping INC. acting as a broker, must share the Client's personal and contact information with third parties involved in the logistics process to facilitate the proper execution of the contracted services. By signing this contract, the Client releases Car Freight Shipping INC. from any liability related to sharing such information in this context.
VEHICLE PREPARATION
The Client must ensure the accuracy of the information provided to Car Freight Shipping INC. including the vehicle's VIN, if required.
The Client will be responsible for preparing the vehicle for transportation as follows (but not limited to):
- The vehicle must be empty, except for factory-installed items. Only vans, work units, and trailers may transport cargo inside, subject to prior approval and payment of a corresponding fee.
- The customer is responsible for ensuring the unit is fully prepared and available for pickup on the dates agreed upon during the negotiation.
The customer must pay a deposit to initiate the transportation arrangement process. If the customer decides to cancel before a carrier is assigned by Car Freight Shipping Inc., $75 will be retained from the deposit paid as an administrative fee.
- The vehicle must be in operable and functional condition unless otherwise communicated in advance.
- All non-permanent external frames, low suspension spoilers, accessories, and loose parts must be removed or firmly secured. The Client assumes responsibility for any items detached during transit, including damages caused to their vehicle or to other vehicles and/or individuals involved in the transportation due to such detachment.
- Any alarm systems must be deactivated. Car Freight Shipping INC. is not liable for battery depletion caused by active alarms.
- The Client accepts and acknowledges that Car Freight Shipping INC. will not be responsible for any damage, loss, or harm that may arise during transportation. This includes, but is not limited to, the following: worn or broken parts or items stored inside the vehicle, vehicle rental expenses, lodging expenses, existing or emerging mechanical failures, damages to mechanical and operational parts of the vehicle, or any other issue or circumstance that may arise during or after the provision of the service. The Client understands that these risks are inherent to the transportation process and agrees to assume responsibility for any expenses or losses resulting from such eventualities.
- Remove all personal belongings from the vehicle, as well as other items such as alcoholic beverages, jewelry, furs, money, live pets, live plants, explosives, firearms, ammunition, flammable products, narcotics, legal documents (including the vehicle title), and any illegal or contraband property. The Client acknowledges and agrees that Car Freight Shipping INC, the carrier, and/or its agent may confiscate or dispose of such items without the right to a refund. Car Freight Shipping INC. is not responsible for the loss of the Client's personal belongings.
DEPARTURE AND ARRIVAL DATES
- Car Freight Shipping INC. will provide the Client with estimated departure and arrival dates for maritime and/or land transportation, as applicable. However, it is clarified that these dates do not represent guaranteed timelines. Delays may occur before and/or during transport due to various circumstances, such as road or sea conditions, adverse weather, and/or unforeseen mechanical issues. The Client acknowledges that these factors may impact the established timelines.
- Clients must consult their sales representative regarding additional charges applicable to non-operational vehicles or those with body and/or tire modifications (e.g., wheelchair ramps, spoilers, dual or oversized wheels, roof racks, lifts, low-profile designs, air intakes, bumpers, front ends, etc.). If Car Freight Shipping INC. is not notified in advance of pickup about the vehicle's lack of functionality and/or such modifications, the Client will be required to pay all additional charges before delivery to the port. Furthermore, the vehicle may be subject to rejection due to lack of availability or appropriate equipment for its transport.
LAND TRANSPORTATION
- Car Freight Shipping INC. and its subcontracted carrier will pick up and deliver the vehicle as close to the specified location as legally and safely possible. If residential restrictions (e.g., narrow streets or low-hanging trees) apply, the driver will determine the pick-up/drop-off location for the vehicle.
- The Client and Carrier will inspect the vehicle for pre-existing damage and complete a Vehicle Inspection Report (Bill of Lading). Both parties will confirm the vehicle's condition at pick-up and delivery. The Client will sign and receive a copy of the Bill of Lading and the report.
- The Carrier assumes responsibility for the vehicle after the Client signs the pre-inspection report. The Carrier's responsibility ends when the vehicle is delivered, and the Client has signed the final inspection report.
- The Client must notify Car Freight Shipping INC. in advance of any unavailability at the scheduled time and appoint an authorized representative (aged 18 or older) to sign for the vehicle.
- Car Freight Shipping INC, the contracted ocean and land carriers (if applicable), are authorized by the Client to operate and transport their motor vehicle between the agreed-upon locations described in the Bill of Lading (B.O.L.), according to the contracted services. The Client understands that transporting the vehicle may require driving it up to a maximum of 10 miles. The Client authorizes Car Freight Shipping INC, the Carrier (if applicable), and agents to drive the vehicle as necessary to complete the transportation.
- Once the order has been dispatched or a carrier has been assigned, NO changes to the pick-up and/or delivery address, or to the type of vehicle to be transported, will be allowed.
- The customer must note and specify on the Bill of Lading the damage to the unit regardless of weather conditions, time, etc. If the customer signs the Bill of Lading without noting any physical damage to the car, he or she is accepting that the vehicle was received in good condition. Car Freight Shipping INC. and the Carrier are released from any further liability.
- The Customer will be responsible for making payment ONLY in cash for the amount agreed upon in the contract at the time of receiving the vehicle at the destination.
- The Customer agrees that in the event of failure to make the freight payment in cash, Car Freight Shipping INC. will not be able to deliver the vehicle and the vehicle will be placed in storage. All storage and reshipment charges will be entirely the responsibility of the Customer. The Carrier will handle this process directly, and Car Freight Shipping INC. will take no part in this process.
SERVICE FEES
- The Client must pay all transportation fees to Car Freight Shipping INC. and agrees not to dispute charges due to delays or damages during transportation.
- The customer must pay a deposit to initiate the transportation arrangement process. If the customer decides to cancel before a carrier is assigned by Car Freight Shipping Inc., $75 will be retained from the deposit paid as an administrative fee.
- The amounts to be paid for the services are listed in the quotation and/or invoice; however, due to various factors such as fuel costs, weather conditions, limited carrier availability in the area and errors in measurements, weight of the unit, and/or unreported extra charge, the agreed rates for domestic or international services may vary (increase) without prior notice. For this reason, the customer is responsible for paying the outstanding balance before receiving or picking up the unit, as applicable.
- This Agreement shall be construed in accordance with the laws of the State of Florida. Any legal forum arising from this contract will be held in Broward County, Florida. The Customer agrees to pay all legal fees associated with the agreement. The parties intend for this choice of venue to be binding and to prevent the possibility of litigation between the parties related to this Agreement or arising from it in any jurisdiction other than the one specified in this section. Each party waives any right they may have to object to the venue in relation to any agreement made after this section.
- This Agreement and all shipments are subject to the rates, as well as all terms and conditions, of the inland and/or maritime carriers (if applicable). Car Freight Shipping INC. will inform the Customer of such changes, and the Customer agrees to comply with them.
ADDITIONAL CHARGES
- Car Freight Shipping INC. is not liable for extra charges from carriers or shipping companies. The customer is responsible for paying any additional charges to which the vehicle being transported may be subject, such as:
- CARGO/ADDITIONAL ITEMS: In the event that the vehicle contains cargo and/or personal items that were not previously authorized by Car Freight Shipping INC., an additional fee set by the carrier (not by Car Freight Shipping INC.) will be incurred. The car should not contain more than 50 lbs of items, and they must be placed in the trunk.
- INTERVENTIONS: If, at the time of shipment, the vehicle does not start and/or has a flat tire, the Customer authorizes the Shipping Company to take any necessary actions to enable the shipment of the vehicle, including towing, jump-starting, inflating the tire(s), or any other intervention made for the same purpose, with the Customer assuming the additional charge incurred.
- DIMENSIONS: The rate quoted by Car Freight Shipping INC. is based on the unit data provided by the Customer. The Customer is responsible for providing the actual weight and dimensions (length, width, height - top to bottom). If the unit exceeds the dimensions before being transported, the Customer will be responsible for paying the additional excess charge to Car Freight Shipping INC. before the vehicle's arrival at the destination port.
CANCELLATIONS AND REFUNDS
- Car Freight Shipping INC. reserves the right to reject and/or cancel any service at any time and for any reason, at its sole discretion. In the event that Car Freight Shipping INC. exercises this right, the customer will be refunded the amount of money previously paid, minus the costs for services already executed and an additional 5% as an administration fee.
The customer must pay a deposit to initiate the transportation arrangement process. If the customer decides to cancel before a carrier is assigned by Car Freight Shipping Inc., $75 will be retained from the deposit paid as an administrative fee.
- Suppose the Customer cancels his transportation service once a carrier has been assigned. In that case, Car Freight Shipping INC. will retain a flat $100 administrative fee. Suppose the driver arrives at the pickup location and cannot load the vehicle. In that case, he will also be charged $100 for the dry run fee and the $100 administrative fee. In either case, all charges will be deducted from payments previously made. Likewise, suppose the Carrier has already picked up the car. In that case, the Customer will not be able to cancel the service and therefore will not receive any refund.
- The "Convenience Fee" or processing fee for any transaction is non-refundable.
CLAIMS
- Car Freight Shipping INC. will not be responsible for any incidental damage caused by hail, storms, snow, or worn or broken parts/items stored inside the vehicle. Likewise, Car Freight Shipping INC. will not be responsible for mechanical, electrical, or operational failures of the vehicle.
- For land transport, upon receipt of the vehicle, the Customer must sign the Bill of Lading and Inspection Report, noting any damage (if present) in the specified location, regardless of weather conditions, time of day, or vehicle cleanliness. When the Customer signs the Bill of Lading and Inspection Report without noting any damage, they confirm that the vehicle has been received in good condition. Car Freight Shipping INC. and the Carrier are exempt from any further liability.
- If the customer notices any damage upon receiving the vehicle, they must file a claim directly with the driver at that moment and attempt to reach an agreement, whether by deducting the amount from the agreed cash payment, having the carrier send a check, or having the carrier cover the cost of repairing the damage. Car Freight Shipping INC. holds no responsibility.
- This Agreement supersedes all previous oral and written representations of Car Freight Shipping INC. This Agreement is final and cannot be modified except in writing and signed by an agent of Car Freight Shipping INC.
